Disability Laws

Morehead State University is committed to achieving an accessible educational environment per federal and state regulations. To support that aim, the Office of Disability Services welcomes immediate and direct input from the entire campus community so that any issues can be quickly and satisfactorily addressed. We also solicit feedback from students with disabilities through an annual, anonymously submitted survey. Students wishing to make a personal disability-related complaint should refer to the Student Rights and Grievance Procedure information on this site.

LEGAL PROTECTION

Legal protection applies to “... an individual who has a mental or physical impairment which substantially limits one or more major life activities and has a record of having such an impairment; or is regarded as having such an impairment.” These include, but are not limited to, seeing, hearing, speaking, walking, learning, working, caring for oneself or the operation of major bodily functions.


SECTION 504 OF THE REHABILITATION ACT OF 1973

“No otherwise qualified individual with a disability in the United States…shall, solely on the basis of her or his disability, be excluded from the participation in, be denied the benefits of, or be subjected to discrimination under any program or activity which receives federal financial assistance…”


At the University, the modifier "otherwise qualified" indicates that the student meets the necessary academic and technical standards for admission and participation with or without the use of reasonable accommodations.


THE AMERICANS WITH DISABILITIES ACT (ADA) OF 1990, AS AMENDED IN 2008

This legislation expands protection to include public entities, regardless of whether federal funding is received (such as health care, transportation, recreation, employment and educational institutions). It also addresses the accessibility of buildings and communication requirements on behalf of persons having visual, hearing, or speech disabilities.
